Terms of Service

1. Eligibility

You must be at least 16 years old to use PocPin. By using the app you confirm that you meet this requirement and that the information you provide is true. We may suspend accounts we reasonably believe belong to people under the minimum age; you can appeal (section 7).

2. Your account

• You are responsible for keeping your login credentials confidential.
• You are responsible for activity carried out through your account.
• You may not create fake accounts or impersonate another person.
• You may not sell, rent or transfer your account to anyone else.
• Any license plate you add must belong to you.

3. Code of conduct

When using PocPin, you agree NOT to:

• post illegal, harassing, defamatory, obscene or hateful content, or content inciting violence;
• upload sexually explicit imagery or content involving minors;
• harass, stalk or intimidate other users;
• post another person’s personal data (address, phone, documents) without their consent;
• post content that infringes others’ rights — including music, films, images or trademarks you are not allowed to use;
• use the service for spam, fraud, scams or location spoofing (fake GPS);
• collect data about other users without consent, or access PocPin by automated means (bots, scraping) without our written permission;
• spread viruses or malicious code, or attempt to bypass security or moderation measures;
• repeatedly submit manifestly unfounded reports or appeals.

4. Your content and the license you grant us

You keep all rights to the content you post (photos, reels, stories, text, sounds). You are solely responsible for it and you warrant that you own the necessary rights or have the rights holders’ permission — including for the music and sounds in your clips.

You grant us a non-exclusive, royalty-free, worldwide license to host, store, reproduce, technically adapt (e.g. resize, compress, convert formats), display and distribute your content, solely to operate, secure and improve PocPin. We may use providers (e.g. storage and content delivery) acting on our behalf.

You allow other users to view your content according to your visibility settings and to use the original sound of your public reels in their own clips through the “Use sound” feature.

The license ends when you delete the content or your account. Deleted content disappears from the app immediately; technical and backup copies are removed within 35 days at most. Exceptions are content we are legally required to keep and clips other users already made with your sound before deletion.

We may restrict or remove content that breaches these Terms or the law; in that case we inform you and you can appeal (section 7). You can delete your own content at any time.

5. Music and sounds

• PocPin currently holds no licenses from record labels or collective management organisations (e.g. UCMR-ADA, UPFR, CREDIDAM). Do not add music to your clips that you are not allowed to use.
• Sounds from the PocPin library and other users’ “original sounds” may only be used in clips made in PocPin, not for other purposes (e.g. downloading, redistributing or commercial use outside the app).
• An original sound stays available only while the reel it comes from is published. If that reel is deleted or removed (including after a copyright complaint), the sound can no longer be used in new clips. Clips already made with it stay up, but we may remove them if the rights holder asks.
• Promotional or paid content must be clearly marked as advertising and may not use music without a commercial license.

6. Copyright and intellectual property

We respect intellectual property rights. If you hold rights (or represent the holder) and believe content on PocPin infringes them, report it in the app (reason “Copyright”) or at [email protected]. The notice must include:

• your name and contact details;
• the protected work or trademark and proof that you hold the rights (or represent the holder);
• the exact link to the content concerned;
• a statement that the notice is made in good faith and that the information is accurate and complete.

6a. Repeat infringement

We handle notices with priority and promptly remove infringing content. The author is informed and can appeal. Accounts that repeatedly infringe the rights of others are suspended or permanently closed.

7. Moderation, decisions and appeals

We may remove content, restrict features or suspend accounts that violate these Terms or the law. Images are automatically screened for nudity. You can report content or users directly in the app, and users can be blocked.

There is zero tolerance for objectionable content (illegal, obscene, harassing, defamatory or discriminatory) and for abusive users. We review reports and act within 24 hours of receipt, removing the flagged content and/or suspending the responsible account. By using PocPin you agree to this zero-tolerance policy.

When we restrict your content or account, we tell you about the decision and the reason for it, unless the law or the safety of others does not allow it. We tell the person who reported the outcome of the review.

You can appeal any decision, free of charge, within 6 months by writing to [email protected]. Appeals are reviewed by a person, not only automatically, and the decision can be reversed. Under Regulation (EU) 2022/2065 (Digital Services Act) you may also turn to a certified out-of-court dispute settlement body or to the competent court.

After a warning, we may temporarily suspend accounts that frequently submit manifestly unfounded reports.

8. License plate

Plate search is optional and controlled by each user. Changing your plate has a cooldown period to prevent identity abuse. Using this feature for harassment is prohibited.

PocPin stores only the license plates that users add voluntarily and does NOT access official vehicle registries (e.g. DRPCIV) or any other public database. Adding a plate is a self-declaration that it belongs to you. You can report an account using a plate that is not theirs.

If a plate is reported as used without right, we may ask you for proof (for example the vehicle registration certificate, with any personal data we do not need covered), which we use only for the check and then delete. If we do not receive it within 7 days, we may remove the plate from your account; for repeated abuse we may suspend the account.

9. Deleting, suspending and closing accounts

You can delete your account anytime in Settings. Deletion is permanent and removes your content, as described in section 4.

We may suspend or close an account for serious or repeated breaches of these Terms, at the request of authorities, or for serious security risks. Except in urgent cases, we tell you in advance, with the reason, and you can appeal (section 7).

10. Coins and purchases

• PocPin offers "coins" (virtual currency) that can be bought via in-app purchases processed solely by the Apple App Store or Google Play. The price is shown before you confirm payment.
• Coins are used only inside the app (e.g. to send gifts). They are virtual items: they have NO monetary value, are non-transferable, and cannot be exchanged for or withdrawn as cash.
• Gifts sent and coins spent cannot be cancelled or returned. Gifts received cannot be withdrawn or exchanged for money.
• Purchases are generally non-refundable except where required by law or by Apple/Google policies. Refund requests are handled through Apple/Google under their policies.
• We do not store your card details; payment is handled entirely by Apple/Google. We may change prices and coin packs.

11. PocPin’s rights

The PocPin name, logo, design and software belong to us. You may not copy, modify, decompile or use them other than for normal use of the app without our written permission. If you send us ideas or suggestions, we may use them without any obligation to you.

12. Limitation of liability

PocPin is provided "as is". We apply reasonable professional diligence, but we do not guarantee the service will be uninterrupted or error-free and we do not review user content before it is published. To the extent permitted by law, we are not liable for indirect damages arising from use of the app.

Nothing in these Terms limits our liability for damage caused intentionally or by gross negligence, for death or personal injury, or the rights you have under consumer protection law.

13. Changes

We may update these Terms to reflect changes to the service or the law. For material changes we will notify you in the app at least 15 days in advance, except for changes urgently required by law or security. If you disagree, you can delete your account before they take effect; continued use after that date means acceptance.

14. Governing law and disputes

These Terms are governed by the laws of Romania. We first try to resolve any complaint amicably — write to us at [email protected]. If you are a consumer, you may also contact the Romanian National Authority for Consumer Protection (ANPC), including its alternative dispute resolution (ADR/SAL) procedure, or the courts where you live.
